The application stands disposed of. W.P.(C) 1608/2026 3. This petition is filed with the following prayers:- “1. Issue a writ of Certiorari or any other appropriate writ, order or direction quashing the Rejection Slip dated 27.11.2025 issued by Respondent No.2 (ITBP), whereby the Petitioner (Roll No.4031001465) was arbitrarily disqualified in the Physical Standard Test (PST) on the alleged ground of insufficient chest expansion; 2. Issue a writ of Mandamus or any other appropriate direction directing Respondent No.2 to conduct a fresh and independent re-measurement of the Petitioner's physical standards, particularly chest measurement, through a neutral and independent Medical Board of a Government Hospital or any other independent authority as this Hon'ble Court may deem fit and proper; 3. Pass an interim direction permitting the Petitioner to provisionally appear in the Written Examination for the post of Assistant Commandant (Telecommunication), ITBP, in the event the examination is scheduled prior to the final adjudication of the present Petition and/or completion of the re-measurement process, subject to the outcome of this Petition;” 4. In effect, the petitioner is challenging his disqualification in the Physical Standard Test (PST) on the ground of insufficient chest expansion. The petitioner was examined on 27.11.2025 both by the Medical Board and also the Appellate Medical Board wherein his chest measurements are as follows:- Stage Normal (cm) Expansion (cm) PST 81 84.1 Appellate Medical Board 79 83 5. The case of the petitioner by relying upon the annexure P5, which is the result of the PST undertaken by the SSB, is that he has been found fit in respect of measurement of his chest both - normal and expanded. 6. Having heard the learned counsel for the parties and also noting the fact that in another identical PST carried out by the SSB, similar organization under the Government of India, the petitioner has been found fit, in the peculiar facts of the case, appropriate shall be a fresh PST of the petitioner is undertaken on 09.02.2026 at 11.00AM at RH Hospital, ITBP NOIDA, UP, when the petitioner shall appear. 7. It goes without saying that both the parties shall be bound by the outcome of the fresh PST to be undertaken in terms of this order. 8. The petition is disposed of in above terms. 9.
