This writ petition is directed against an order dated 22 April 2025 passed by the Armed Forces Tribunal1, granting disability pension to the respondent. 2. The respondent, at the time of his joining the Air Force on 1 October 1987, was fit and not found to be suffering from any ailment or disability. 3. The Primary Hypertension and Dyslipidemia, which were the ailment on the basis of which the AFT has granted the disability pension to the respondent, had their onset on 22 November 2014, 27 years after the respondent had joined the service. 4. The respondent was released in low medical category. The Release Medical Board proceedings which are on record confirm that the respondent was suffering from Primary Hypertension to the extent of 30% and Dyslipidemia to the extent of 1-5% for life. Despite this, the respondent has been treated as disentitled to disability pension. 5. The reasoning in the Release Medical Board proceedings read thus: “Onset of disability Nov 14 at CH (EC) Kolkata. No close time association with stress and strain of Field/HAA/CIOPS service. Hence NANA in terms of para 43 of Ch VI of GMO 2008.” 6. In cases with the very same reasoning, we have granted disability pension in as many as 206 cases, including Union of India v. Ex. SGT Manoj K L Retd2, Union of India v. Rajveender Singh Mallhi3 and Union of India v. Koutharapu Srinivasa4 cases including UOI v. Ex Sub Gawas Anil Madso5. 7. We have not been informed that any of these decisions has been stayed or set aside by any judicial authorities. 8. Accordingly, as this case is entirely covered by the aforesaid decisions, the writ petition is dismissed. 9. Compliance with the order of the AFT be positively ensured within six weeks from today. C.
