Ms. Jahnavi Singh, learned Counsel for the petitioner, submits that the petitioner has challenged the impugned order dated 7 April 2026 passed by the Central Administrative Tribunal1 in OA 3476/2022 only to the extent it grants 50% back wages to the respondent from the date of his termination. 2. She submits that, while passing the said directions, the Tribunal did not examine the aspect of whether the respondent was gainfully employed in the interregnum. 3. To a query from the Court, Ms. Rathore, learned Counsel for the respondent, submits, on instructions, that her client was not gainfully employed after his services were terminated by the petitioner. 4. In that view of the matter, we make the operation of para 18(iii) of the judgment dated 7 April 2026 subject to the respondent furnishing an affidavit to the petitioner within a period of two weeks from today, at the e-mail id of learned Counsel appearing for the petitioner today, to the effect that the respondent was not gainfully employed after the termination of his services. 5. With the said clarification, this writ petition is disposed of. C.
