CM APPL. 59770/2026	 (condonation of delay in filing petition)

1. Mr. Sanwal, learned counsel for the respondent, points out that this writ petition is not maintainable ab initio, as it has been filed by counsel who appeared for the MTNL before the Tribunal.

2. Mr. Pragyesh Pratap Singh, learned counsel for the petitioner,  submits that Mr. Shashwat Sharma, who had filed the writ petition has relinquished his vakalatnama and the client has engaged Mr. Pragyesh Pratap Singh. 

3. That, however, may not cure the defect, as the writ petition, from the time of its very institution, may not be maintainable, having been filed by a counsel who had appeared for the opposite party before the Tribunal.

4. Instead of entering into the somewhat embarrassing issue, Mr. Pragnesh Pratap Singh, learned counsel for the petitioner, seeks leave to withdraw the writ petition with liberty to reinstitute the writ petition in his own name. Leave and liberty is granted as aforesaid.  

5. The writ petition is disposed of, in the aforesaid terms.  

6. The date of 13 October 2026, already fixed in the matter, stands cancelled.
