1. At the outset, Mr. Nitin Kala, learned Counsel for the Petitioner, submits that the present petition is rendered infructuous on the ground that parties have already arrived at a settlement. 

2. As both the parties have signed the mediation and conciliation agreement dated 21.09.2026, the cause of action does not survive. 

3. Both parties undertake that they will abide by the settlement terms contained in the mediation and conciliation agreement dated 21.09.2026. 

4. Accordingly, the present petition is dismissed as infructuous.
