1. This is an application filed under Section 151 of CPC, 1908 seeking for release of interest amount.  


 
2. For the reasons stated in the application, the same stands allowed and the remaining amount shall remain lying with the Registry.

3. It appears from the record that the stamp duty filed by the 


Decree Holder is beyond one month from the execution of the award. 


 
4. At this stage, learned Counsel appearing for the Petitioner seeks leave to withdraw the present petition with liberty to file it again as and when situation arise after depositing adequate stamp duty as per Indian Stamp Act, 1899, applicable in the NCT of Delhi and in line with the judgement passed by this Court in M/s URC Construction (P) Ltd. v. Airports Authority of India1.
