1. At the outset, learned Counsel appearing for the Respondent No. 2 disputes the arbitral agreement between the Petitioner and Respondent No. 2 and accordingly, raises his objection against this petition.  


 
2. Learned Counsel appearing on behalf of Respondent No. 1 submits that 50% of the payment i.e. the Petitioner’s share has already been deposited with the Bank.  


 
3. At this stage, learned Counsel appearing for the Petitioner seeks leave to withdraw the present petition with liberty to avail the 


appropriate remedy before appropriate forum.  


 
4. Leave and liberty as aforesaid is granted.  


 
5. The present petition is dismissed as withdrawn.
