1. It is apparent from the record that the arbitral award sought to be enforced in the instant petition is dated 04.11.2025. However, the stamp duty on the same was paid on 25.03.2026, which is undoubtedly beyond one month from the date of the execution of the arbitral award.  


 
2. This is not in consonance with the scheme envisaged by the Indian Stamp Act, 1899, as applicable in NCT of Delhi or in view of the judgment passed by this Court in M/s URC Construction (P) Ltd. v. Airports Authority of India1.

3. At this stage, learned Counsel appearing for the Decree Holder 


seeks leave to withdraw the present petition with liberty to file the same afresh, as and when the situation arises, after depositing the requisite stamp duty and penalty, if any, in accordance with the Indian Stamp Act, 1899, as applicable in NCT of Delhi. 


 
4. Leave and liberty, as aforesaid, is granted.  


 
5. The petition is, accordingly, dismissed as withdrawn.
