1. At the outset, learned Counsel appearing for the parties agree that, in terms of the relevant clause of the contract between the parties, the parties are required to first attempt conciliation before invoking the arbitration mechanism. 


 
2. Accordingly, Petitioner seeks leave to withdraw the present petition, with liberty to approach this Court as and when situation arises.  


 
3. In view of the aforesaid contractual stipulation, the parties are at liberty to undertake the conciliation process in terms of the contract.   


 
4. The present petition is accordingly dismissed as withdraw. 


 
5. Leave and liberty as aforesaid, is granted.
