1. It is apparent from the record that the stamp duty deposited on the arbitral award sought to be enforced in the instant petition is deposited beyond 30 days. 


 
2. This is not in consonance with the scheme envisaged by the Indian Stamp Act, 18991, as applicable in NCT of Delhi and the judgment passed by this Court in M/s URC Construction (P) Ltd. v. Airports Authority of India2.

3. At this stage, learned Counsel appearing for the enforcement Petitioner seeks leave to withdraw the present petition with liberty to file it again as and when the situation arises after satisfying on the aspect of the stamp duty as per the judgment in M/s URC 


Construction (P) Ltd. v. Airports Authority of India(supra). 


 
4. Leave and liberty, as aforesaid, is granted. 


 
5. The present enforcement petition is dismissed as withdrawn with aforesaid liberty.
