JUSTICE OM PRAKASH SHUKLA JUDGMENT(ORAL) % 14.09.2026 The case is being listed today as 11.09.2026 was declared a Holiday vide Notification No. 86/G-4/Genl.-I/DHC dated 08.09.2026. 1. The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of a Sole Arbitrator for adjudication of the disputes arising between the parties out of the Contract dated 21.11.2017 for consultancy services relating to preparation of feasibility studies and Detailed Project Reports for various road stretches in Bihar. 2. Clause 9.2 of the GCC read with Clause 9.2 of the SCC contains the arbitration agreement between the parties and provides for reference of disputes to arbitration. 3. It is borne out from the record that the Petitioner vide notice dated 26.12.2024 invoked the arbitration clause in terms of the Section 21 of the Act. 4. It is well settled that, while exercising jurisdiction under Section 11 of the Act, the scope of enquiry is confined to examining the prima facie existence of an arbitration agreement. 5. In the present petition, there is no dispute pointed out by the learned Counsel for the Respondent with regard to the existence of a valid arbitration clause between the parties or maintainability of the present petition. 6. In the aforesaid circumstances, this Court finds no impediment in appointing a Sole Arbitrator. 7. Accordingly, Mr. Amit George, Advocate (Mob. No. +91-9910524364) is appointed as a learned Sole Arbitrator to adjudicate the disputes arisen between the parties. 8. Learned Sole Arbitrator shall proceed to the arbitration proceedings subject to furnishing the disclosure as required under Section 12(2) of the Arbitration and Conciliation Act, 19961 within four weeks of entering reference. 1 “Act” hereinafter 9. The arbitration shall be carried under the rules and aegis of Delhi International Arbitration Centre (“DIAC”). The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 10. It shall be open to the parties to raise all pleas, including objection as to arbitrability and jurisdiction, before the learned Sole Arbitrator who shall decide the same in accordance with law. 11. It is clarified that the observations made herein are only for the purpose of deciding the present petition under Section 11(6) of the Act. The learned Sole Arbitrator shall adjudicate the disputes with claims and counter claims independently and on their own merits, uninfluenced by any observations contained in the present order. 12. The Registry is directed to send a receipt of this order to Mr. Amit George, learned Arbitrator through all permissible modes including email. 13. At this stage, learned Counsel for the Respondent submits that he is willing to settle the matter with the Petitioner amicably out of the Court. 14. Three weeks’ time is granted for exploring the possibility of settlement through negotiations. 15. The learned Sole Arbitrator shall enter upon the reference after four weeks from the date of this order to enable the parties to try and resolve their disputes through negotiations and settlement. 16.
