1. It appears from the record that the arbitral award sought to be enforced is dated 12.12.2017. However, the stamp duty has been deposited on 21.08.2026, which is beyond one month from the date of execution of the award.  


 
2. This is not in consonance with the scheme envisaged by the Indian Stamp Act, 1899, as applicable in NCT of Delhi1 in view of the judgment passed by this Court in M/s URC Construction (P) Ltd. v. Airports Authority of India2.

3. At this stage, Mr. Harshit Singh, learned Counsel appearing for the Decree Holder seeks leave to withdraw the present petition with 


liberty to file a fresh petition as and when the situation arises and after complying with the requirement of payment of stamp duty on the Award as per the Indian Stamp Act, 1899.  


 
4. Leave and liberty, as aforesaid, is granted.  


 
5. The present enforcement petition is dismissed as withdrawn with the aforesaid liberty.
