The present petition has been filed by the petitioner under Article 227 of the Constitution of India, seeking the following relief: “Issue appropriate directions to the Ld. ADJ, Tis Hazari Courts, Delhi, to pronounce orders within a time-bound period on the Petitioner’s application under Order XII Rule 6 CPC in CIV DJ/560/2023” 4. Learned counsel for the petitioner submits that the respondent has been served through his counsel. 5. The grievance of the petitioner is that the application filed under Order XII Rule 6 of the Code of Civil Procedure, 1908 (“CPC”) on behalf of the petitioner has not yet been decided, despite arguments having been heard on multiple dates, i.e., 24th October 2024, 14th November 2024, 05th December 2024 and 08th January 2025. The relevant order sheets of the learned Trial Court have already been placed on record. At present, the matter is stated to be pending for clarification/arguments/orders. The suit of the petitioner is not progressing on account of the pendency of the decision on the said application. 6. Keeping in view of the submissions of the learned counsel for the petitioner and upon perusal of the order sheets, it is evident that the application filed under Order XII Rule 6 CPC in September 2024 has been pending for orders. Keeping in view the aforesaid facts and in the interest of justice, let the concerned Trial Court decide the said application expeditiously in accordance with law. 7.
