The present Petition, filed under Section 25-B(8) of the Delhi Rent Control Act, 19581, seeks to assail the Order dated 19.02.20192 passed by the learned ARC, Shahdara District, Karkardooma Courts, Delhi3 in Eviction Petition, being ARC 1250/20164, titled “Sh. Madan Pal Singh v. Sh. Ashok Gulati”, in respect of the tenanted premises, being Shop. No. 7, Ground Floor, Property No. 4/1956, Gali No. 14, Pandav Road, Vishwas Nagar, Bholanath Nagar, Shahdara, Delhi-1100325. 2. Learned counsel appearing on behalf of the parties submit, on instructions, that the parties have arrived at an amicable settlement and are agreeable to have the present proceedings disposed of in terms thereof. 3. Mr. Sachin Gulati, one of the Legal Representatives of the original Petitioner, is present in person. It is submitted that instructions have also been obtained from the other Legal Representatives of the original Petitioner as well. 4. Learned counsel for the parties, on instructions, submit that the following terms of settlement have been agreed upon between the parties: I. The Legal Representatives of the Petitioner shall vacate and hand over peaceful and vacant possession of the Subject Premises to the Respondent within a period of six (06) months from today i.e., on or before 15.03.2026. II. The Legal Representatives of the Petitioner shall pay a sum of ?25,000/- to the Respondent, inclusive of the arrears of rent, within a period of four (04) weeks from today. 5. The Legal Representatives of the Petitioner shall file an affidavit of undertaking incorporating the aforesaid terms before this Court within a period of two (02) weeks from today. It is made clear that, in the event of failure to furnish the undertaking within the stipulated period, the Legal Representatives of the Petitioner shall be liable to vacate the Subject Premises forthwith. 6. The Legal Representatives of the Petitioner further undertake that, in the event of any breach or violation of the undertaking furnished before this Court, the Respondent shall be at liberty to avail of such remedies as may be permissible in law, including initiation of contempt proceedings, in accordance with law. 7. In view of the settlement arrived at between the parties, no further adjudication is called for in the present proceedings. The present Petition, along with the pending Application(s), if any, stands disposed of in terms of the aforesaid settlement. 8.
