The present Contempt Petition [“present Petition”] has been filed under Sections 10 and 12 of the Contempt of Courts Act, 1971 [“CC Act”] read with Section 151 of the Code of Civil Procedure, 1908 [“CPC”] against the Respondents/ Contemnors alleging non-compliance with the Final Judgment/Order dated 22.11.2013 passed by this Court in W.P.(C) 1050/2000, titled “Bam Dev Chhetri & Ors. v. Jawaharlal Nehru University & Anr.” and connected matters, as well as Order dated 10.01.2017 passed by this Court in W.P.(C) 1050/2000, titled “Bam Dev Chhetri & Ors. v. Jawaharlal Nehru University & Anr.”. 2. This Court takes note of the Compliance Report refiled on 22.11.2022 and other documents placed on record on behalf of the Respondent No. 1, setting out the status of compliance with the directions passed by this Court vide Orders dated 22.11.2013 and 10.01.2017. The relevant portion of the document filed on 23.11.2022, being an extract of the Note of the Administration Branch-I of Respondent No.1, reads as under: “COMPLIANCE STATUS OF COURT ORDER DATED 22.11.2013 in W.P. No. 1050/2000 The following 05 were petitioners in W.P No. 1050/2000:- 1. Shri Jai Prakash, Assistant 2. Shri Dharamvir, Ex. Caretaker 3. Shri Puran Singh Negi, Ex.Caretaker 4. Shri Anil Kumar Arora, Ex.Caretaker 5. Shri Pehluddin, Caretaker, Ex. Caretaker In pursuance of the Hon'ble High Court of Delhi's order dated 22.11.2013, The pay of Shri Dharamvir and Shri Pehluddin has been revised/restored in the pay scale of Rs.1350-2200 in terms of notification dated 24.03.1996 and subsequently revised in the pay scale of Rs. 4500-7000 under 5th CPC w.e.f. 01.01.1996 and in the Pay Band (Rs. 5200-20200 + Rs.2800 Grade Pay w.e.f. 01.01.2006, Copies of office order No. 122/2014 dated 24.04.2014 in r/o Shri Dharamvir and office order No. 177/2014 dated 24.04.2014 in r/o Shri Pehluddin are enclosed. (Annexure-I) In regard to remaining 03 petitioners i.e. Shri Jai Prakash, Shri Puran Singh Negi and Shri Anil Kumar Arora, their pay was already been fixed in the terms of the Notification dated 21.03.1996 in the year 1996 with notional effect w.e.f. 01.01.1986 and financial benefit w.e.f. 05.02.1996, Further, the OUM scale of Rs. 1200-2040 granted to them was also revised/upgraded to Rs. 1640-2900 and their pay was fixed accordingly. They continued to draw pay in pre revised scale under 4th CPC pending the outcome of W.P. 1050/2000 and in terms of the Court Order dated 05.02.2010, their pay was revised in the pay scale of Rs.5500-9000 (5th CPC) and PB-2. Rs. 9300-34800 + GP 4200 (6th CPC). The pay scales of Rs. 1350-2200 granted to petitioners i.e. Sh. Anil Kumar Arora and Sh. Puran Singh Negi as per the University notification dated 21.03.1996, were neither withdrawn nor their pay was reduced. As such, both the employees already enjoyed/drawn the pay in higher scale. Hence, there was no need of revision of pay in said cases. Copies of office order No. 139/2014 dated 01.05.2010, office order No. 142/2010 dated 01.05.2010 in r/o of Sh. Jai Prakash, office order No. 140/2014 dated 03.05.2010, Office order No. 141/2010 dated 03.05.2010 in r/o of Sh. Puran Sing and office order No. 143/2010 dated 04.05.2010, office order No. 144/2010 dated 03.05.2010 in r/o of Sh. Anil Kumar Arora, are enclosed. (Annexure-II) COMPLIANCE STATUS OF COURT ORDER DATED 10.01.2017 in W.P. No. 1050/2000 The following 02 were petitioners. 1. Shri Anil Kumar Arora, Ex. Caretaker 2. Shri Puran Singh Negi, Ex. Caretaker The pay scales of Rs. 1350-2200 granted to petitioners i.e. Sh. Anil Kumar Arora and Sh. Puran Singh Negi as per the University notification dated 21.03.1996, were neither withdrawn nor their pay was reduced. As such, both the employee already enjoyed/drawn the pay in higher scale. Hence, there was no need of revision of pay in said cases as per the replies which were forwarded to Legal Cell vide notes dated 02.05.2014, 06.05.2014, 07.05.2014, 28.10.2015, 04.04.2016 and 09.06.2016 (Copies enclosed) Annexure-III If approved, the above may be forwarded to Dy. Registrar, Legal Cell for taking further necessary action in this regard.” 3. It is, accordingly, the case of the Respondents, as reflected from the aforesaid Compliance Report, that the directions issued by this Court had already been duly complied with as early as in the year 2022. 4. This Court also takes note of the contents of the Order dated 21.04.2023, wherein a submission was made on behalf of the Petitioners that, if any amount continued to remain outstanding, the same would be set out by way of a Reply Affidavit. The Petitioners were also granted liberty to address a communication, within a period of two (02) weeks, to the Registrar, Jawaharlal Nehru University, with respect to the amounts, if any, which continued to remain outstanding, with a copy thereof to be marked to the counsel appearing for Respondent No.1. Respondent No.1 was, in turn, directed to consider such communication and respond thereto within a period of four (04) weeks. The relevant portion of the said Order reads as under: “4. The learned counsel for the Petitioners states that he seeks time to take instructions from the Petitioners. He states that in case the Petitioners are of the opinion that there is some amount that continues to remain outstanding, he will file a reply affidavit duly tabulating the amounts that are in arrears. 5. The Petitioners are also granted liberty to address a communication to the Respondent with respect to the amounts, if any, that remains pending, within two (2) weeks from today. The communication be marked to the present Registrar of Jawaharlal Nehru University with a copy marked to the counsel appearing for Respondent No. 1. 6. In case, such a communication is issued by the Petitioners, Respondent No. 1 is directed to consider the said communication and respond thereto within a period of four (4) weeks.” 5. It is significant that despite the aforesaid opportunity having been granted to the Petitioners in 2023, no such communication or Reply Affidavit, setting out any specific amount allegedly remaining unpaid, has been placed on record. The matter has, thereafter, continued to remain pending. 6. Respondent No.1 has now placed on record a Short Affidavit dated 05.01.2026 in the nature of a Compliance Affidavit. The said Short Compliance Affidavit reiterates that Shri Anil Kumar Arora and Shri Puran Singh Negi had been granted the pay scale of Rs.1350-2200 with the requisite benefits and had continuously drawn the same without any interruption, reduction or recovery. In respect of the remaining Petitioners, the Respondent states that their pay was restored in terms of the Order/Judgment dated 22.11.2013 and that the consequential revisions under the 5th and 6th CPC had also been extended to them. The Respondent consequently asserts that no monetary dues, arrears or service-related benefits remain outstanding and that the Respondents have duly complied with the directions passed by this Court vide Orders dated 22.11.2013 and 10.01.2017. The relevant portion of the Compliance Affidavit is reproduced hereinbelow: “MOST RESPECTFULLY SHOWETH: 1. That in accordance with the University notification dated 21.03.1996, the Petitioners namely, Sh. Anil Kumar Arora and Sh. Puran Singh Negi, were granted the pay scale of 1350-2200 in the year 1996 with notional effect w.e.f. 01.01.1986 and financial benefits w.e.f. 05.02.1996. It is further submitted that pursuant to the aforesaid grant, the said pay scale was continuously drawn by the Petitioners without any interruption. At no point of time was the pay scale so granted either withdrawn, revised downward, or subjected to any recovery, nor was the pay of the said Petitioners ever reduced. As such, the abovementioned Petitioners have enjoyed a higher pay scale. Hence, there was no need of revision of pay. Copies of the benefits granted to Sh. Anil Kumar Arora and Sh. Puran Singh Negi from the date of appointment to the date of retirement are annexed here as Annexure-1(Colly). 2. That it is further respectfully submitted that in compliance with the order dated 22.11.2013 passed by this Hon’ble High Court in W.P.(C) No. 1050/2000, the pay of the remaining Petitioners was restored in the pay scale of Rs. 1350-2200 in terms of notification dated 21.03.1996 and subsequently revised in the pay scale of Rs. 4500-7000 as per the 5th CPC w.e.f. 01.01.1996 and in the Pay Band-I Rs. 5200-20200+2800GP w.e.f. 01.01.2006 as per the 6th CPC. It is submitted that all consequential benefits arising out of the aforesaid revisions have already been duly extended to the remaining Petitioners. Accordingly, no monetary dues, arrears, or service-related benefits remain outstanding or payable by Jawaharlal Nehru University, and the directions issued by this Hon’ble Court stand fully complied with.” 7. Learned counsel appearing on behalf of the Petitioners, at this stage, orally submits that no payments have been made. This Court, however, finds that the said submission is not supported by any material placed on record. As noticed hereinabove, the Petitioners were granted an opportunity as early as on 21.04.2023 to controvert the assertion of the Respondents regarding compliance and to place on record the particulars of any amount which, according to them, continued to remain outstanding. 8. Even as of today, there is nothing on record placed by the Petitioners which would controvert the assertion of the Respondents that the directions passed vide Order dated 22.11.2013 have not been complied with. In particular, no communication, reply affidavit, tabulation of arrears or other document has been placed on record demonstrating any specific amount or benefit which remains outstanding. 9. In view of the aforesaid position, and particularly considering the long pendency of the matter and the absence of any material evidencing the alleged non-compliance, this Court is not inclined to keep the present proceedings pending any further. 10. Accordingly, taking into consideration the Compliance Report filed on 22.11.2022 as well as the Compliance Affidavit dated 05.01.2026 filed by Respondent No.1 herein, this Court is of the view that no further orders are necessary in the present proceedings. 11.
