The present Petition has been filed under Article 227 of the Constitution of India, 19501 assailing the Order dated 17.08.20262, passed by the learned Judge, Family Court-01, South-West District, Dwarka Courts, New Delhi3, in the Execution Petition bearing No. Ex. CIVIL 37/20264, arising out of case being HMA 729/2025, titled “Urmila Negi v. Dinesh Singh Negi”, whereby despite service upon the Respondent/Judgment Debtor and his appearance through counsel in the execution proceedings, no effective order towards execution of the maintenance Order dated 01.04.2026 was passed, and the matter was adjourned to 11.12.2026 along with the main proceedings in HMA No. 729/2025. 2. Learned counsel appearing on behalf of the Petitioner submits that the Respondent/Judgment Debtor stands duly served and has entered appearance through counsel in the execution proceedings. It is, however, contended that despite the aforesaid circumstances, no effective or substantive direction has been passed for securing compliance with the Order for interim maintenance dated 01.04.2026. 3. Learned counsel further submits that the matter has now been adjourned to 11.12.2026, i.e., for a period of nearly four (04) months, and that such deferment would seriously prejudice the Petitioner, particularly when the order sought to be executed pertains to payment of interim maintenance. 4. Learned counsel appearing on behalf of the Petitioner has also placed reliance upon the judgment of a learned Co-ordinate Bench of this Court in Mohd. Yusuf v. Kanwar Singh Saini Since Deceased Through LRs5. The relevant portion of the aforesaid Judgment reads as under: “8. Be that as it may, in view of the facts presented before this Court, the present petition is disposed of with direction to learned Executing Court to take up the above said petition afresh and to give a shorter date for disposal of the objection petition.” 5. This Court has heard the learned counsel appearing on behalf of the Petitioner and, with his able assistance, perused the material placed on record. 6. At the outset, this Court is of the view that the grievance raised by the learned counsel for the Petitioner, insofar as it relates to the date fixed before the learned Family Court, can appropriately be addressed by availing of the remedies available before the learned Family Court itself. Learned counsel for the Petitioner would, therefore, be at liberty to move an appropriate Application seeking preponement of the date fixed in the aforesaid execution proceedings and for consideration of the execution petition at an earlier date. Learned Trial Court is requested to consider the same as favourably as permissible. 7. This Court, exercising jurisdiction under Article 227 of the Constitution, cannot be called upon to regulate the day-to-day listing or board of a subordinate Court, particularly in the absence of any material demonstrating a jurisdictional error, patent illegality or perversity warranting interference in the exercise of supervisory jurisdiction. The mere fact that the learned Family Court has fixed a date at a subsequent point of time, by itself, would not warrant invocation of the extraordinary supervisory jurisdiction of this Court. 8. In view of the aforesaid, this Court finds no ground to exercise its supervisory jurisdiction under Article 227 of the Constitution of India. The present petition is, accordingly, dismissed. 9.
