This is a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, seeking quashing of FIR No.80034848/2026, dated 28th April, 2026, registered at P.S Bindapur, District Dwarka, Delhi under Section 305 BNS (380 IPC) and all proceedings emanating therefrom on the basis of compromise arrived at between the parties. 2. Mr. Sanjay Lao, the learned Senior Counsel appearing for the respondent no. 1 has handed over the copy of the Status Report which is taken on record. 3. On 28th April, 2026, the present FIR was registered through the e-FIR web application on the complaint of Shri. Giri Raj Prasad, who reported theft of silver ornaments, old silver coins, gold articles (including a nose pin) and cash of Rs. 73,800 from his house on 26th April, 2026. 4. During investigation, petitioner nos. 1 and 2 were arrested. Petitioner no. 2 is the grandson of the complainant Shri. Giri Raj Prasad and petitioner no. 1 is the friend of petitioner no. 2. Cash amount of Rs. 1,15,000/- was recovered from the house of petitioner no. 1 and cash amount of Rs. 2,43,054/- was recovered from the house of petitioner no. 2. Certain gold/silver ornaments, including a pair of earrings, a nose pin and a broken kada were also recovered, which were identified by the complainant as his stolen property. 5. During investigation, petitioner nos. 1 and 2 had disclosed that they had sold the silver items to petitioner no. 3, Mr. Rajesh Kumar Kataria. Upon interrogation, petitioner no. 3 stated that he had purchased the silver, melted it, and paid Rs. 5,10,000/- in cash to petitioner no. 1. The melted silver weighing 2.433 kg was recovered from him and seized. 6. It is submitted that parties have now amicably resolved their disputes and the terms of compromise were reduced into writing in the form of Memorandum Of Understanding/Compromise Deed 18th September, 2026 and as per the settlement, respondent no. 2 has received 198 coins, 3 pair of toe rings, one pair of gold earrings, one nose pin and cash amount of Rs. 5,58,054/- . Additionally, petitioner nos. 1 and 2 have paid a sum of Rs. 1,00,000/- (Rupees One Lac) each (Rs. 2,00,000/- in total) to respondent no. 2 by way of bank drafts. It has been submitted that in terms of the agreement, the silver weighing 2.433 kgs has been handed over/ released to petitioner no. 3/ Mr. Rajesh Kumar Kataria. The copy of Memorandum of Understanding/Compromise Deed dated 18th September, 2026 is annexed as Annexure P-2. 7. Parties are physically present before the Court. They have been identified by the advocate as also by the Investigating Officer ASI Rajesh from PS Bindapur. 8. Respondent no. 2 confirms that the matter has been amicably settled with the petitioners without any force, fear, coercion and he has received the entire settlement amount and has no objection if the FIR No. 80034848/2026 is quashed against the Petitioners. 9. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 11. Consequently, to secure the ends of justice, FIR No. 80034848/2026, dated 28th April, 2026, registered at P.S Bindapur, District Dwarka, Delhi under Section 305 BNS (380 IPC), along with all consequential proceedings emanating therefrom, is hereby quashed. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court, so that these become part of Trial Court Record and shall also be submitted to concerned SHO/IO within four weeks from today. 12.
