This is a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, seeking quashing of FIR No. 0611/2021, dated 01.11.2021, registered at P.S Ambedkar Nagar, Delhi under Sections 498A/406/506/34 IPC along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The marriage between complainant (respondent No.2 herein) and petitioner no.1 was solemnized on 19.01.2004 as per Hindu rites. One child was born from the abovesaid wedlock and is of 20 years of age, currently residing with respondent no.2. 3. However, on account of temperamental differences, the parties started residing separately since 23.09.2019. The complainant/ respondent no. 2 alleged that she was subjected to harassment and cruelty by her husband and in-laws on account of dowry demands, including demands for cash, jewellery and a plot, besides physical and verbal abuse, interference with her studies, denial of household and educational expenses, and other matrimonial disputes. She further alleged that the petitioner, while under the influence of alcohol, physically assaulted her and their daughter, shifted the household belongings to another premises, and threatened her with consequences if she initiated legal proceedings. An FIR was registered on the instance of respondent no.2. 4. During the course of proceedings, the parties mutually and amicably resolved their disputes before the Counselling Cell of Family Court, Saket Courts vide Settlement Agreement dated 28.05.2025. It is submitted that petitioner no. 1 and respondent no. 2 have obtained divorce on 09.10.2025 and the petitioner no. 1 has paid the entire settlement amount of Rs. 3,50,000/- (Rupees Three Lakhs Fifty Thousand Only) as full and final settlement. Copy of the Settlement Agreement dated 28.05.2025 has been annexed. 5. Petitioner No.1 and Respondent no. 2 are physically present before the Court. They have been identified by their respective counsels as well as by the Investigating Officer SI Nikhil Kumar, from PS Ambedkar Nagar. 6. Respondent No.2 confirms that the matter has been amicably settled with the petitioners without any force, fear, coercion and she has received the entire settlement amount and therefore has no objection, if the FIR No. 0611/2021 is quashed against the Petitioners. 7. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 8. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 9. Consequently, to secure the ends of justice, FIR No. 0611/2021, dated 01.11.2021, registered at P.S Ambedkar Nagar, Delhi under Sections 498A/406/506/34 IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court, so that these become part of Trial Court Record and shall also be submitted to concerned SHO/IO within four weeks from today. 10.
