CRL.M.C. 758/2026

1. The present petition seeks quashing of FIR No. 85/2025 dated 23.10.2025, registered at Police Station Cyber Police Station East for commission of offence under Section 318(4) Bhartiya Nyaya Sanhita (BNS), 2023 (corresponding Section 420 of IPC), along with all consequential proceedings emanating therefrom, on the basis of compromise arrived at between the parties.
2. The abovesaid FIR was lodged on the basis of a complaint made by  Sh. Vikas Kumar (respondent No.2 herein), who reported about online fraud whereby he lost a sum of Rs.1,54,629/-.  
3. During investigation, police reached the alleged beneficiary i.e. petitioner Ms. Diya Devi. 
4. It is now informed that both the sides have entered into settlement and Settlement Deed has been reduced in writing on 26.01.2026 and as per the settlement terms, the entire allegedly cheated amount has already been returned to the complainant. 
5. The complainant i.e. respondent No.2 is present in Court and he also submits that he has received the entire amount and, therefore, he is no longer interested in pursuing with the abovesaid FIR.  He also submits that he has entered into the abovesaid settlement with his free will and without any coercion or force from anyone whatsoever.  
6. The case has been registered only for commission of offence under Section 318(4) Bhartiya Nyaya Sanhita (BNS), 2023 which is compoundable in nature. 
7. Keeping in mind the overall facts and circumstances of the case and in view of the fact that settlement has been arrived at between the parties, continuing with criminal proceedings would serve no useful purpose. In any case, even the complainant does not wish to press any charges against anyone. 
8. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR.
9. Consequently, to secure the ends of justice, FIR No. 85/2025 dated 23.10.2025, registered at Police Station Cyber Police Station East for commission of offences under Section 318(4) Bhartiya Nyaya Sanhita (BNS), 2023 along with all consequential proceedings emanating therefrom, is hereby, quashed.
10. The petition stands disposed of in aforesaid terms.
