Respondent No.2 in person CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. The petitioners seek quashing of FIR No.535/2017 dated 06.07.2017, registered at P.S. Narela, for commission of offences under Sections 323/354(B)/509/34/354 of IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. Complainant (respondent No.2) reported on 01.05.2017 that when she was present at her house situated in Bawana, all the accused persons came outside her house and started putting a banner on the gate of her house. When she objected to the same, all the accused started abusing her and used filthy language. When she came down, she was given fist blows and her clothes were, reportedly, torn and her modesty was outraged by touching her inappropriately. Her such report resulted into registration of abovesaid FIR. 3. Charge-sheet has already been filed against all the accused persons i.e. all eight petitioners herein. However, charges are yet to be framed. 4. Learned counsel for the petitioners submits that there was mere clash of political ideology and petitioner No.1 was contesting election for the post of MCD Councillor on the ticket of Bahujan Samaj Party (BSP) and had come with a banner of said party which was objected to by the complainant. 5. However, the matter has now been amicably settled and both the sides have signed Compromise Deed on 22.02.2025. A copy of such deed has been placed on record. 6. Respondent No.2/complainant is present in the Court and is duly identified by the Investigating Officer, who is also present in Court. 7. When asked, respondent No.2 reiterated that the matter has been amicably settled between the parties. She submits that Compromise Deed dated 22.02.2025 bears her signatures. According to her, with the intervention of respectable persons of the society and some common persons, both the sides have mutually settled the matter and, therefore, she has undertaken to cooperate with the quashing of instant FIR. She submits that she has settled the matter with her own sweet and free-will without any threat, force or coercion from any corner, whatsoever. She also submits that she would have ‘no objection’ if FIR in question is quashed. Her affidavit to abovesaid effect has also been placed on record. 8. The next date of hearing before the learned Trial Court is stated to be 04.04.2026. 9. In view of the settlement arrived at between the parties, continuing with the criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 11. Consequently, to secure the ends of justice, FIR No.535/2017 dated 06.07.2017 registered at P.S. Narela for commission of offences under Sections 323/354(B)/509/34/354 of IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed subject to petitioners depositing total cost of Rs.40,000 /- with Delhi High Court Staff Welfare Fund [Account no. 15530110074442: IFSC UCBA0001553] within three weeks from today. 12. Both the sides would ensure that the original affidavits of both the parties alongwith the Compromise Deed and proof of deposit of such cost are submitted before the learned Trial Court within further two weeks, so that these documents become part of Trial Court Record. 13. The petition stands disposed of in aforesaid terms. 14. Pending application also stands disposed of in aforesaid terms. 15. Copy of this order be also sent to learned Trial Court for information.
