Versus THE STATE (GOVT. OF NCT OF DELHI) .....Respondent Through: Mr. Sanjay Lao, Standing Counsel (Crl.) with Insp. Raj Kumar and SI Neeraj Kumar. CORAM: HON'BLE MR. JUSTICE VIVEK CHAUDHARY HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T 1. The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the B.N.S.S., 2023, whereby the petitioner, seeks a writ in the nature of habeas corpus directing the respondents to produce his wife, Mrs. Paramjeet Kaur, before this Court, who is stated to be under the illegal detention of one Mr. Inderpal Singh. 2. The petitioner submits that the alleged detenue, Mrs. Paramjeet Kaur, came into contact with Mr. Inderpal Singh through social media in January 2025. On 03.04.2025, Mr. Inderpal Singh met her in Delhi, disclosed his association with one unlawful organization, and attempted to induce her to join his activities, which she declined and disclosed to her husband/petitioner. On 31.05.2025, Mrs. Paramjeet Kaur, however, left her matrimonial home and has not returned thereafter. The petitioner apprehends that she had left her home, at instance of Mr. Inderpal Singh. 3. Learned Standing Counsel, on instructions, has handed over a status report today and submits that the detenue herself contacted the ASI and stated that she had, voluntarily, left her matrimonial home of her own free will. 4. Today, Mrs. Paramjeet Kaur has appeared before this Court through video-conferencing. When asked, she stated that she is 32 years of age and has completed a Diploma in Art and Craft after passing XII Class. She, very clearly and categorically, states that she does not wish to reside with petitioner and affirms that her stand is voluntary, of her own violation, and without any coercion, or undue influence. 5. Our interaction with her leaves no manner of doubt that she does not wish to accompany the petitioner. 6. Since Mrs. Paramjeet Kaur is educated and is competent to take her own independent decision, no further orders are required to be passed in the present petition. 7. Resultantly, the present petition is disposed of in the aforesaid terms. Needless to say, the parties are at liberty to approach appropriate Court for seeking any relief in relation to their marriage and custody of children. 8. Pending application also stands disposed of.
