$~55 * IN THE HIGH COURT OF DELHI AT NEW DELHI Date of Decision: 14th September, 2026 # CNR No. DLHC010431762026 + CRL.M.C. 6755/2026&CRL.M.A. 28260/2026 HARISH SHARMA .....Petitioner Through: Mr. Harendra Kumar, Advocate with petitioner. versus STATE (NCT OF DELHI) AND ANR. .....Respondent Through: Mr. Satinder Singh Bawa, APP with ASI Umesh Chand CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioner herein seeks quashing of FIR No. 506/2015 dated 16.05.2015, registered at Police Station K N Katju Marg, for commission of offences under Sections 354A/506/509 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The abovesaid FIR was registered on the basis of complaint made by respondent No.2 herein who was at the relevant time pursuing her Masters from IGNOU. She claimed that when she returned to her home on 16.05.2015, accused came there and started misbehaving with her. He also banged on the door of their house and when her mother came out, he assaulted both of them and also intimidated her that he would also throw Acid on her face. Based on the abovesaid allegations, said FIR was registered. 3. The case is, reportedly, at the stage of Prosecution Evidence. 4. Copy of Compromise Deed dated 03.09.2026 has been placed on record. 5. Respondent No. 2 is present in person and has been duly identified by Investigating Officer. 6. When asked, she reiterated the terms of the settlement recorded in Compromise Deed dated 03.09.2026 and states that she would have ‘no objection’ if FIR in question is quashed. She submits that the settlement is without any monetary consideration or any condition. She also submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever. She also submits that there is no surviving friendship between them and in view of the amicable dissolution of the disputes, she would have ‘no objection’ to the quashing of the FIR. She submits that her father has already died and her mother, who had received injuries in the present incident, also died five years back. She submits that she has lost her husband. 7. She, however, verifies the correctness of the abovesaid settlement. 8. Keeping in mind the overall facts and circumstances of the case and the fact that the parties have amicably settled their disputes, this Court is of the considered view that the continuation of the criminal proceedings would serve no useful purpose. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 9. Consequently, FIR No.506/2015 dated 16.05.2015, registered at Police Station K N Katju Marg, for commission of offences under Sections 354A/506/509 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed subject to petitioner depositing total cost of Rs. 20,000/- with Delhi High Court Legal Services Committee within four weeks from today. 10. Proof of deposit of cost, Compromise Deed and original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within two weeks from today, so that these become part of Trial Court Record. 11. The petition stands disposed of in aforesaid terms. 12. Pending application also stands disposed of. (MANOJ JAIN) JUDGE SEPTEMBER 14, 2026/sw/sk CRL.M.C. 6755/2026 1
