CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. A complaint was filed against the petitioner herein. After being summoned, arguments on charge were heard and vide order dated 18.12.2023, the learned Magisterial Court directed the petitioner to be charged under Sections 23 and 25 of Pre-conception and Pre-natal Diagnostic Techniques (PCPNDT) Act, 1994 for violating Rules and Sections 4, 5 and 29 of said Act. 2. Such order was challenged by filing a revision petition before the learned Court of Sessions and such revision petition had been dismissed on 20.12.2025 and now the abovesaid revision petition has been filed by the same petitioner i.e. Dr. Anoop Gupta against the abovesaid orders. However, as per Section 438(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), if a revision has been filed by any person, either to the High Court or to the Sessions Judge, no further application by the same person shall be entertained by the other of them. 3. In view of the above, the second revision petition by the same petitioner is not maintainable. 4. The petition is disposed of as not maintainable. 5. However, the petitioner would be at liberty to take recourse to any other remedy, as permissible under law. 6. Needless to clarify, there is no observation on merits of the case.
