				J U D G M E N T (oral)

1. Petitioner herein seeks quashing of criminal proceedings which have been initiated against him in terms of Complaint Case bearing No. 9392/16, titled as “Court Proceedings v/s Pradeep Kumar Chawla”, pending in the Court of Sh. Apoorv Bhardwaj, JMFC-02, North West, Rohini Courts, Delhi, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
2. The attention of the Court has been drawn towards order dated 24.03.2009 passed by this Court, while hearing Crl. Rev. P. No. 341/2008. This Court observed that there existed a prima facie case for proceeding against Pradeep Kumar Chawla for committing offence under Section 211 IPC.
3. This Court had also observed that the intention of the petitioner herein was to cause injury or to cause any criminal proceeding to be instituted and since a complaint had been filed by him with a false intent, the abovesaid direction was given. 
4. Based on the abovesaid direction, a complaint was, accordingly, instituted way back in the year 2013. 
5. In the interregnum, the actually aggrieved person, against whom such case had been instituted by the petitioner herein, has expired. 
6. Sh. Ratan Lal Chhabra has died on 25.07.2016. His death certificate is on record. It is submitted that after his unfortunate demise, his son and sole surviving Legal Representative i.e. Bharat Bhushan (respondent No.2 herein), is pursuing the matter and the parties have been entered into an amicable settlement, as would be apparent from the mediation proceedings dated 28.07.2026.
7. Such mediation agreement is found to be signed by Pradeep Kumar Chawla (petitioner herein), respondent No.2 Bharat Bhushan and respondent No. 4 Vishnu Kathuria. In terms of mediation settlement, connected matters have also been settled. 
8.  The abovesaid complaint is still, reportedly, at the stage of pre-charge evidence. The next date before the learned Trial Court is stated to be 07.10.2026.
9. It is submitted that since the actual aggrieved person i.e. Sh. Ratan Lal Chhabra has already expired and since the matter has been amicably settled by his surviving Legal Representatives, no useful purpose would be served by keeping the abovesaid complaint alive. 
10. The parties are present in Court. 
11. Respondent No.2 Bharat Bhushan has been duly identified by IO. Mr. Abhishek Pal, Advocate who has appeared on behalf of Respondent No.2 identifies him and also seeks permission to place on record his Vakalatnama. His Vakalatnama is taken on record.  
12. Keeping in mind the overall facts of the case, the fact that the actual aggrieved person has already expired and that the matter has been amicably settled before the Mediation by his surviving LR, it is deemed expedient to quash the proceedings. Consequently, to secure the ends of justice, Complaint Case bearing No. 9392/16, titled as “Court Proceedings v/s Pradeep Kumar Chawla”, pending in the Court of Sh. Apoorv Bhardwaj, JMFC-02/Sucessor Court, if any, North West, Rohini Courts, Delhi, along with all consequential proceedings arising therefrom, is, hereby, quashed.
13. The petition stands disposed of in aforesaid terms.
14. Pending application also stands disposed of.
