The accused/applicant seeks regular bail in case FIR No. 07/2026 of PS Cyber, New Delhi District for offence under Section 112(2)/317(2)/318(4)/61(2) of BNS. 2. Despite the seriousness of circumstances mentioned in last orders, the updated status report of DCP concerned has not been filed. 3. Learned APP for State, on instructions of IO/SI Komal and Inspector Manish Verma, SHO, PS Cyber, New Delhi, submits that prosecution has no objection if the present accused/applicant also is granted regular bail. 4. Broadly speaking, the allegation against the present accused/applicant is that being part of cyber fraud network, he is one of the beneficiaries of the allegedly cheated amount. As per prosecution case, the allegedly cheated amount came into the bank account held jointly by the present accused/applicant and co-accused Saleem. 5. One of the major grounds for seeking bail is that the co-accused Saleem as well as the remaining accused persons, namely H.S. Kohli, Sandeep, Nasim and Santosh have not been arrested. The argument on behalf of the accused/applicant has been that the police cannot be allowed to pick and choose when it comes to arresting an accused. On this aspect, order dated 25.08.2026 noted the submission of the IO that she had decided to arrest Saleem but the senior police officers told her not to do so. On this aspect, a detailed updated status report from the concerned DCP was called, but that report has not been filed. 6. It is in these circumstances that learned APP for State, on instructions of both police officers present in courtroom, submits that State has no objection to grant of bail to the present accused/applicant on the principle of parity. 7. Accordingly, this bail application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the Trial Court/Duty Magistrate. 8. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
