The accused/applicant seeks regular bail in case FIR No. 50/2019 of PS Narela Industrial Area for offence under Section 302/120B/34 IPC and Section 25/27/54/59 of Arms Act. 2. Broadly speaking, the allegation against the accused/applicant is that along with two more persons, while travelling in a car, the present accused/applicant and co-accused, Sukhvinder fired gunshots which turned fatal to the deceased. 3. On behalf of accused/applicant, it is submitted that he is in custody since 17.02.2019 and till date only 07 prosecution witnesses out of 44 witnessses have been examined. It is also submitted by learned counsel that co-accused Sukhvinder, who has been attributed role exactly similar to that of the present accused/applicant, has already been granted bail. 4. Learned APP for State assisted by IO/Inspector Sudhir Rathi as well as learned counsel for family of the deceased, in all fairness do not dispute that the role alleged against the present accused/applicant is similar to the role attributed to co-accused, Sukhvinder. Learned counsel for family of the deceased also lays emphasis on the brutality of the crime, but also does not dispute that till date, neither she nor the learned prosecutor has challenged the order whereby bail was granted to co-accused, Sukhvinder. Learned APP also submits that the present accused/applicant is involved in another case for offence under Section 307 IPC, but also admits that in the said case the accused/applicant is already on bail. 5. In view of the above circumstances, on the principle of parity, the bail application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the Trial Court/Duty Magistrate. 6. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
