J U D G M E N T    (ORAL)

1.	Petitioner seeks quashing of case FIR No. 48/2022 of PS Sunlight Colony for offence under Section 279/338 IPC on the ground that the complainant de facto (respondent no.2) has settled the disputes with the petitioner.

 2.	State has no objection to this petition. Statements of parties have already been recorded by the concerned Joint Registrar.

3.	On 23.09.2026, I had heard the petitioner as well as respondent no.2 and the matter was urgently assigned to the court of Joint Registrar for recording statements and for payment of the balance compensation of Rs.20,000/-. The statements were accordingly recorded and the matter has been placed back before this court as directed in order dated 23.09.2026. On 23.09.2026 itself, for reasons recorded in the order it was directed that the petitioner and respondent no.2 need not appear today as I had already spoken with both of them.

4.	It appears that for the grievous hurt suffered by respondent no.2 on account of alleged rash and negligent driving by petitioner, in the compensation proceedings before MACT, the respondent no.2 was paid compensation of Rs.2,80,000/- and in addition to that, the present petitioner had already paid him cash amount of Rs.22,000/- after which, the balance compensation of amount of Rs.20,000/- was payable before the court of Joint Registrar at the time of statements of the parties. That amount also now stands paid.

5.	In view of previous record and above circumstances, I am satisfied that it would be in the interest of justice, not to push the parties through full dress trial.
6.	Therefore, the petition is allowed and FIR No. 48/2022 of PS Sunlight Colony for offence under Section 279/338 IPC as well as proceedings arising out of the same are quashed.
