J U D G M E N T    (ORAL)

1.	The accused/applicant seeks anticipatory bail in case FIR No.800037855/2026 of PS Laxmi Nagar for offence under Section 305 BNS.
2.	At the outset, learned APP for State, assisted by IO/SI Sachin Sharma, submits that the accused/applicant was arrested and produced before the trial magistrate on 24.07.2026, after which the IO was granted two days police custody and thereafter, on 27.07.2026 the accused/applicant was released on bail by the magisterial court. It is submitted by learned APP that neither the accused/applicant nor his counsel nor even the IO or the APP before the trial court disclosed about pendency of the present application. It is submitted by learned APP that the accused/applicant obtained bail from magisterial court after concealing that in the present anticipatory bail application, no protection from arrest had been granted. 
3.	Learned counsel for accused/applicant does not dispute that the learned magistrate was not informed about pendency of this application and the view taken by this court that no interim relief could be granted.
4.	In view of above circumstances, the anticipatory bail application is dismissed. 
5.	Copy of this order be sent to the concerned magistrate for information and appropriate action. Copy of this order be also sent to the concerned DCP and the Director of Prosecution to enquire into the conduct of the IO as well as learned APP of the magisterial court, who did not disclose before the magistrate about pendency of this application.
