J U D G M E N T    (ORAL)
1.	The accused/applicant seeks regular bail in case FIR No. 269/2022 of PS Kanjhawala for offence under Section 302/34 IPC and Section 25/27 of Arms Act.
2.	Learned APP assisted by Investigating Officer/Inspector Surender submits that there were two murders in the locality, so the status report could not be filed.
3.	At this stage, learned counsel for accused/applicant discloses that the accused/applicant has already been granted interim bail by the Court of Sessions on the ground of pregnancy of his wife. Learned counsel has shown me the bail order dated 31.08.2026 of the Court of Sessions, from which it appears that the Court of Sessions was not informed about the pendency of the present bail application.
4.	As on 31.08.2026, the present bail application was pending, so there was no occasion for the accused/applicant to move before the Court of Sessions another application, even if for grant of interim bail. For, the present application for grant of bail being under consideration of this court any application for interim relief should have been filed before this court only. It appears that the accused/applicant mischievously obtained interim bail from the Court of Sessions.
5.	It is submitted by counsel for accused/applicant that he had informed the Court of Sessions about pendency of the present application. But that finds no mention in the bail order dated 31.08.2026.
6.	Moreover, as on date, the accused/applicant is not in jail, so regular bail application, in any case would not be maintainable.
7.	Since the accused/applicant played fraud on the Court of Sessions and obtained interim bail despite pendency of  the  present  bail  application, I do 
not find it a fit case to grant bail to the accused/applicant. The bail application is dismissed.
8.	Copy of this order be sent to the concerned Court of Sessions.
