	MINI PUSHKARNA, J. (ORAL):
1. By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), the applicant, i.e., Mrs. Seema, w/o Ashok@ Lambu@ Jahrila, seeks interim bail for a period of 45 days, in connection with the First Information Report (“FIR”) being FIR 0276/2024, dated 27th June, 2024, registered at the Police Station (“PS”) Binda Pur, Dwarka, Delhi, under Sections 302/120B/34 of the Indian Penal Code, 1860 (“IPC”). The request is made on humanitarian grounds and in view of the impending surgery of the mother-in-law of the applicant. 
2. The criminal case being SC 651/2024, instituted in connection with the FIR 0276/2024, are pending adjudication before the Additional Sessions Judge-05, South-West District, Dwarka, Delhi, and are at the stage of examining prosecution evidence.  
3. This Court is informed that vide order dated 02nd July, 2026, passed in BAIL MATTER 1115/2026 by the Additional Sessions Judge-05, South-West District, Dwarka, Delhi, the interim bail application of the applicant has been dismissed.

Learned counsel appearing for the applicant submits that the mother-in-law of the applicant is suffering from severe bilateral osteoarthritis in both the knees which has resulted in restricted mobility and severe pain. In view of the same, she is due to undergo a surgery, for which the applicant needs to be present to assist and care for her, during and after this major orthopaedic procedure. 
5. Learned Additional Public Prosecutor (“APP”) for the State has handed over to this Court a Status Report, which is taken on record. 
6. He confirms the fact that the mother-in-law of the applicant, namely, Mrs. Birma Devi, has to be admitted to the hospital, i.e., Gandhi Hospital, Om Vihar, Uttam Nagar, New Delhi, on 28th September, 2026 and that the surgery is scheduled to take place on 30th September, 2026. 
7. The inspector, namely, Ranjit Tokas, present in person before this Court has also verified the medical documents of the mother-in-law of the applicant, which are appended with the Status Report.

This Court records the submissions made by learned counsel appearing for the complainant that there are other members in the family of the applicant, who may be available to look after the mother-in-law of the applicant. However, this Court notes that the husband of the applicant is also in jail.

Considering the fact that the mother-in-law of the applicant is due to undergo a major surgery, and further the categorical submission on behalf of the applicant that she is required to look after her ailing mother-in-law, this Court is of the view that the present is a fit case for granting interim bail.

For the aforesaid reason, the present interim bail application is allowed and the applicant is directed to be released on interim bail in connection with FIR 0276/2024, dated 27th June, 2024, registered at the PS Binda Pur, Dwarka, Delhi, for a period from 28th September, 2026 till 19th October, 2026, subject to furnishing of a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only), with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent/Trial Court/Duty Magistrate and, subject to the following further conditions:
a. The applicant shall not indulge in any criminal activity, in any manner whatsoever, during the period of her interim bail;
b. The applicant shall not, directly or indirectly, attempt to contact the family of the deceased/complainant, or tamper with the evidence, or otherwise indulge in any act or omission that is prejudicial to the proceedings, nor shall she offer any inducement, threat, or promise to any person acquainted with the facts of the case. The Investigating Officer (“IO”) is directed to monitor the situation and, in the event of any complaint being made, to inquire into the same in accordance with law;
c. The applicant shall furnish her mobile number to the IO, and shall keep the said mobile phone in working condition at all times. The mobile number shall not be changed or switched off without prior intimation to the IO;
d. The applicant shall provide her permanent address to the IO, as also the address where she is residing during the pendency of the case. The applicant shall intimate the IO, and file an Affidavit before the Trial Court regarding any change in the residential address;
e. The applicant shall not leave the area of NCT of Delhi, without prior permission of this Court;
f. The applicant shall surrender before the concerned jail positively on or before 19th October, 2026;
g. The applicant shall also place on record before the learned Trial Court all the medical records of her mother-in-law with regards to the surgery. 
11. It is made clear that no further extension of interim bail shall be granted to the applicant. 
12. With the aforesaid, the present application is accordingly allowed and disposed of. 
13. The pending application also stands disposed of. 
14. Copy of the order be communicated to the concerned Jail Superintendent electronically for necessary information and compliance.
